1.1 The Services are Available "AS-IS" Your access to and use of the Services or any Content are at your own risk. You understand and agree that the Services are provided to you on an "AS IS" and "AS AVAILABLE" basis. The "BA.net Entities" refers to BA.net, its affiliates, officers, directors, employees, agents, representatives, partners and licensors. Without limiting the foregoing, to the maximum extent permitted under applicable law, THE BA.net ENTITIES DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGMENT. BA.net entities make no warranty or representation and disclaim all responsibility and liability for: (i) completeness, accuracy, availability, timeliness, security, or reliability of the Services or Content; (ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services or any Content; (iii) the deletion, or failure to store or transmit, any Content and other communications maintained by the Services; and (iv) whether the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from BA.net entities, or through the Services, will create any warranty or representation not expressly made herein.

1.2 Acknowledgement of Risk

You acknowledge that there is always a risk of a Smart Contract Security Breach that leads to loss of your Digital Currency, and in such an event the BA.net Entites disclaim all responsiblity and liability, even if caused by negligence by BA.net Entities or any other cause. THE BA.net ENTITIES DO NOT PROVIDE INSURANCE OR WARRANTY AND YOU WILL NOT BE RECOMPENSATED FOR LOST DIGITAL CURRENCY FOR ANY REASON INCLUDING BUT NOT LIMITED TO THE REASONS STATED ABOVE.

1.3 Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE BA.net ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLESNGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; OR (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE BA.net ENTITIES EXCEED THE GREATER OF ONE HUNDRED U.S DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID BA.net, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT THE BA.net ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

1.4. General

These Terms may be revised at any time. The most current version of the Terms will always govern our relationship with you. By continuing to use the Services after a revision, you agree to be bound by any revised Terms. The laws of Argentina will govern these Terms and any dispute that arises between you and BA.net. All disputes related to these Terms or the Services will be brought solely in the federal located in Arentina, and you consent to personal jurisdiction and waive any objection as to inconvenient forum.

The following terms and conditions govern all use of the nft.ba.net website (the “Website”) and all content, services and products available at or through the Website. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein. This website incorporates the Terms of Service of BA.net, GrandHost.

If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services.

NFT Hosting is not allowed for Not Safe For Work (NSFW) content. Adult, Porn, Offensive content is not allowed.

Image files are limited to 500KBytes, PNG format. NFTs will be minted under the ticker AMKT on Polygon Matic.

NFT Hosting will continue to be provided ad infinitum or until BA.net decides to conclude the NFT.BA.net project. Prior to termination, BA.net will provide 90 days notice to users via email to allow users enough time to make alternative hosting arrangements.

NFT Series Limitations

You can not use the service to carry out any financial activities subject to registration or licensing, including but not limited to creating, listing or buying securities, commodities, options, real estate or debt instruments.

GrandHost Web Service

Web Site up to 1000 MB is provided free by partner GrandHost. Including Cpanel administration. 50G transfer per month. PHP support. Duration of free deal, and number of free MB are not guaranteed.

Prohibited content is Anything Illegal. Including but not limited to Phishing, Streaming, File Lockers, Traffic Redirectors, Forex site, Banking sites, URL Shortening services, Top Lists, Scripts that make automated FTP uploads, Pharmaceutical, Viral, Hacking, Warez, Proxy, Made for Adsense sites, Finance based sites, faucet sites, paid to click. Adult, Porn content is not allowed.
